1 THE C-KERMIT 7.0 AND 8.0 LICENSE

5 This is the new C-Kermit 7.0 and 8.0 license. The intention is to allow
6 C-Kermit to be distributed with "free" operating systems such as GNU/Linux,
7 FreeBSD, NetBSD, OpenBSD, The Hurd, etc, even when the distributions
8 themselves (such as Red Hat or Caldera) might be sold and/or might include
9 applications that are not free, and yet still require a license to include
10 C-Kermit in or with "non-free" products such as commercial OS's, commercial
11 software packages, embedded systems, and hardware (other than general-purpose
12 computers preloaded with "free" operating systems), since these licenses
13 furnish a large portion of the Kermit Project's funding.
15 There have been some questions about the provision in Clause (A) that:
18 C-Kermit source code may not be changed without the consent of the
19 Kermit Project, which will not be unreasonably withheld (this is
20 simply a matter of keeping a consistent and supportable code base).
22 The intention of this clause is primarily to make sure that anybody who
23 makes modifications sends them back to us, since we are the ones have to
24 support C-Kermit, and so we can carry them through to future releases (so
25 you don't have to make the same changes again and again).
27 Secondarily it is to protect Columbia University in the unlikely event of
28 modifications made with deliberate intent to offend or cause damage.
30 Any redistributor of C-Kermit under Clause (A) below should rest assured
31 there is no intention of preventing them from constructing a distribution in
32 the appropriate format (RPM or whatever) for their product or from issuing
33 any patches required for their products; we simply want to be informed so we
34 can maintain a consistent code base and a solid, supportable software
35 package. We are happy to work with any redistributor an any issues that

38 Note: All changes to this file since 1 January 2000 (the C-Kermit 7.0
39 release date) are above; the license itself has not changed, except to
40 update the most recent copyright date.

50 The C-Kermit software may be obtained directly from the Kermit Project at
51 Columbia University (or from any source explicitly licensed by the Kermit
52 Project or implicitly licensed by Clause (A) below) by any individual for
53 his or her OWN USE, and by any company or other organization for its own
54 INTERNAL DISTRIBUTION and use, including installation on servers that are
55 accessed by customers or clients, WITHOUT EXPLICIT LICENSE.
57 Conditions for REDISTRIBUTION are as follows:
59 (A) The C-Kermit software, in source and/or binary form, may be
60 included WITHOUT EXPLICIT LICENSE in distributions of OPERATING
61 SYSTEMS that have OSI (Open Source Initiative, www.opensource.org)
62 approved licenses, even if non-Open-Source applications (but not
63 operating systems) are included in the same distribution. Such
64 distributions include, but are not limited to, CD-ROM, FTP site,
65 Web site, or preinstalled software on a new GENERAL-PURPOSE
66 computer, as long as the primary character of the distribution is
67 an Open Source operating system with accompanying utilities. The
68 C-Kermit source code may not be changed without the consent of the
69 Kermit Project, which will not be unreasonably withheld (this is
70 simply a matter of keeping a consistent and supportable code base).
72 (B) Inclusion of C-Kermit software in whole or in part, in any form, in
73 or with any product not covered by Clause (A), or its distribution
74 by any commercial enterprise to its actual or potential customers
75 or clients except as in Clause (A), requires a license from the
76 Kermit Project, Columbia University; contact kermit@columbia.edu.
78 The name of Columbia University may not be used to endorse or promote
79 products derived from or including the C-Kermit software without specific
80 prior written permission.
